Under the Immigration Reform and Control Act (IRCA), employers with 4 or more employees are prohibited from discriminating against employees and job applicants on the basis of citizenship or national origin. In addition, IRCA prohibits the hiring and continued employment of undocumented aliens who are not authorized to work in the United States. Under IRCA, all employers are required to verify work authorization and identity of all employees through the use of Form I-9 within three days of hire.

Failure to comply with the provisions of the IRCA and related I-9 regulations can result in employee lawsuits and fines ranging from $216 to $2,156 per individual, depending on the type and severity of the violation.

In addition to posting required labor law notices, employers must also ensure compliance with I-9 regulations and the antidiscrimination provisions of the Immigration Reform and Control Act (IRCA). The U.S. Department of Homeland Security (DHS) recently revised its “Right to Work” notice regarding citizenship discrimination, and finalized regulations that modify the list of documents that may acceptable as proof of identity during the I-9 process.
